Kimberly M. Jannotta - Senior Partner, Chair, School Law Practice Group

Kimberly M. Jannotta serves as Chair of the Education Law Practice Group. She was named a Partner in 2018. She concentrates her practice in the areas of school law, labor and employment law, and litigation. Ms. Jannotta has represented clients in State and Federal Courts as well as before the Illinois Educational Labor Relations Board, the U.S. Equal Employment Opportunity Commission, and the Illinois Department of Human Rights. Her experience includes negotitations, arbitrations, employee discipline, student discipline, teacher dismissals, unfair labor practice charges, as well as discrimination and retaliation claims and investigations.

REPRESENTATIVE EXPERIENCE

  • Litigate and manage administrative matters for the school law department including grievance arbitrations, unfair labor practice charges, unit clarification petitions and matters before the Illinois Department of Human Rights, U.S. Equal Employment Opportunity Commission, Illinois Educational Labor Relations Board, Illinois Circuit Courts and Federal Courts
  • Engage in union negotiations and draft successive collective bargaining agreements for educational entities
  • Draft, review and revise policies, employment contracts, commercial contracts, independent contractor agreements, Board resolutions, Board agendas, Board statements, client alerts and legal opinion memoranda
  • Conduct workplace investigations concerning complaints of misconduct, harassment, discrimination and employee administrator trainings
  • Responsible for handling subpoenas, Freedom of Information Act responses, Open Meetings Act compliance issues, student residency disputes, student record requests, student discipline matters, student special education issues, employee termination hearings, employee grievances, employee discipline matters and settlement negotiations
  • Research and advise school districts regarding employee retirement, FMLA concerns, wage issues, competitive bidding requirements and State and Federal statutory compliance
  • Attend and preside over Board meetings and public hearings
  • Act as outside counsel to work on projects for Chicago Public Schools and other school districts regarding transactional work, tenured teacher dismissal hearings and administrator dismissal hearings
